For this project you will first access the "How to Analyze a Legal Case" document below. You will review the analysis process in the document. The information will help you to prepare to analyze the "Case for Legal Thinking" found on page 153 of your student text. In addition to the student text, you will need to research at least 2 additional sources of information regarding Third Story Music, Inc., v. Tom Waits on the Internet. Case analysis reports should answer, in detail, the following information/questions:
a description of the facts that surround the case (a summary)
a statement of the issue or problem posed by the case, a reference to the arguments or various positions that can be taken on the issue
a decision or a result on the issue presented
an explanation of the reasoning behind the decision
Where is the consideration on each side?
If Warner had not promised the royalty payments, would the court have found consideration present here?
If the promise of royalty payment had not been made, would the court have still found for Warner?
Include a Works Cited page that lists your text as well as two other sources
You must utilize Google Docs to complete your written report. Works cited page must be in MLA format. You may use the Citation Machine to help you format the entries. Remember to share your Google Doc with Mrs. Cuellar! Email: Lois.Cuellar@SpringBranchISD.com
You may discuss information with your team members, however, THIS IS AN INDIVIDUAL PROJECT. Each student is responsible for completing the project. The final project grade will count both as a project grade and a test grade for chapter 9.
You will be graded utilizing the rubric below:
